On 13 December 2010, the Federal Court granted Instyle leave to further expand its statement of claim to include allegations that GECA, Environmental Assurance and Petar Johnson have made misleading statements about the compliance of GECA's program with ISO 14024, about GECA's trade mark being a certification trade mark, and to furniture manufacturers and suppliers about them not being able to obtain White Furniture certification.

Craig Emerson MP, Minister for Competition Policy and Consumer Affairs, and expressed concern that the Australian Government procurement policy was giving preference to GECA certified products. The Minister confirmed that ".. Commonwealth procurement policy does not preference products certified by GECA".

Notwithstanding, many Government procurement policies exclude the use of Instyle's benchmark sustainable textiles (and other sustainable products from other suppliers) because they instead preference the purchase of products certified by Good Environmental Choice Australia (GECA).

GECA, Environmental Assurance and Petar Johnson's legal representatives accept that Instyle's claims are legitimate.
GECA and Environmental Assurance have made public statements suggesting that INSTYLE's claims in its Federal Court case are "misconceived", and that INSTYLE's action in bringing its claims is unlawful.

INSTYLE filed its claim against GECA, Environmental Assurance and Petar Johnson in the Federal Court of Australia on 25 June 2009 alleging breaches by them of the Trade Practices Act and of the NSW Fair Trading Act.
Pursuant to the Federal Court Rules, GECA, Environmental Assurance and Petar Johnson were required to file their defences by 5 August 2009.
